  2. By entering the Jean & Ric Edelman Fossil Park Museum at Rowan University and all property accessible with a ticket (collectively, the “Museum”) operated by Rowan Educational Attractions, Inc. (“REA”), ticket purchasers and users entering the Museum’s property (“Guests”) represent and certify that they have reviewed and accepted each of the terms and conditions of this revocable license (this “Revocable License”) for themselves, and on behalf of any minors accompanying them. Adult Guests represent that they are legally competent to agree to the terms of this Revocable License on behalf of themselves and all accompanying minors and will be responsible for the behavior and actions of all such minors while they are at the Museum. All minors must be accompanied by an adult Guest at all times and Guests may not touch any exhibit except those exhibits that expressly allow touching or interaction. By entering the Museum, you are agreeing to these terms and conditions on behalf of yourself and any minors you accompany. If you do not agree to these terms, return the ticket immediately for a refund and do not enter the Museum.


  3. Except as expressly stated herein, this ticket is a non-refundable, limited license for access to the Museum, which access may be revoked by REA without a refund at any time with or without cause. Tickets are person- and date-specific, non-transferable and subject to the Museum’s rules. Except as stated otherwise herein, no refund, exchange, or re-sale, is permitted once Guests have entered the Museum.


  4. Adult Guests, on behalf of themselves and all minors they accompany, represent that the adult Guest is responsible for the behavior and actions of themselves and any and all accompanying minors. Adult Guests, on behalf of themselves and all minors they accompany, specifically understand, acknowledge and agree that:

  5. 1.visiting the Museum and participating in any Museum activity may involve some level of risk and carries with it the potential for serious injury, property loss, and other damages.

  6. 2.the adult Guest, and any accompanying minors, assume all risk of injury, harm, and incident arising out of or from access to the Museum, including, without limitation, a) risk associated with exposure to or contraction of infectious disease or illness, b) all other risk of personal injury, and c) risk of lost, stolen or damaged property.

  7. 3.there are inherent risks of injury from fall or accidents from visiting the Museum’s playground and quarry dig site which are in areas of uneven or shifting terrain.

  8. 4.visiting the Museum’s Critter Cove exhibit may involve interaction with live animals and risk of contact with zoonotic disease (disease between humans and animals), injury, bites, and/or allergic reactions.


  9. Adult Guests agree, on behalf of themselves and all minors they accompany, to assume all risk of injury, harm, or incident arising from access to the Museum or the use of this ticket, including, without limitation, a) risk associated with exposure to or contraction of infectious disease or illness, b) risk of other personal injury, and c) risk of lost, stolen or damaged property.


  10. Adult Guests, on behalf of themselves and all minors they accompany, hereby PROMISE NOT TO SUE, WAIVE, RELEASE, FOREVER DISCHARGE, INDEMNIFY AND HOLD HARMLESS Rowan Educational Attractions, Inc., Rowan University, the State of New Jersey and/or their directors, trustees, officers, owners, shareholders, landlords, faculty, employees, organizers, volunteers, representatives, agents, activity holders, sponsors, and all their successors and assigns (each, a “Released Party”) from and against any and all claims, liability, costs and damages (“Claims”), arising out of or related to their and/or their accompanying minor’s access to the Museum or from the use of this ticket, including but not limited to Claims resulting from (i) a Released Party’s negligence, (ii) personal injury, (iv) property damage, or (v) exposure to or contraction of infectious disease or illness.


  11. Adult Guests, on behalf of themselves and any accompanying minors, hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident and/or illness while onsite at the Museum.


  12. All persons and bags are subject to security checks. Wagons, folding bicycles, skateboards and similar items are not permitted in the museum. Subject to the discretion of the Museum’s staff, no bags or backpacks larger than 8” x 12” x 18” are permitted in the galleries. A self-serve cloakroom is available to leave belongings, but the Museum is not responsible for lost or stolen items, and Guests should carry phones and other valuables on their person. Double strollers are typically not permitted in galleries due to space constraints.


  13. No dangerous objects, including guns, knives, weapons, pepper spray, fireworks, flammable substances, lighters or matches, or illegal drugs are permitted anywhere on the Museum’s property. The Museum is a non-smoking, tobacco-free, and e-cigarette-free facility. Aside from water in reusable, sealable bottles and baby formula, outside food and drink should not be brought into the Museum building or to the quarry dig site.


  14. Adult Guests and all minors they accompany may be filmed and/or photographed during their visit for the Museum’s promotional or security purposes. As partial consideration for the grant of the limited license by REA and by using this ticket, adult Guests, on behalf of themselves and all minors they accompany, irrevocably grant REA, and such third parties as the REA may authorize, permission to use their image, likeness, name, voice, comments, or other proprietary or public rights, for promotional purposes, including in any media, without monetary compensation. Guests are welcome to take photographs and video for personal use, however, such photographs and video cannot be used for broadcast, publication, or any commercial purpose without the prior written permission of REA.


  15. REA’s employees or representatives may refuse admission to the Museum property, or eject, Guests if they are deemed, in the sole discretion of REA’s employees or representatives, disruptive or disorderly (including, but not limited to, being under the influence of alcohol, drugs, or other substances); or fail to comply with the REA’s or the Museum’s Health, Safety, and Conduct Policy; or disregard instructions of the Museum or REA employees or representatives, or disregard the terms and conditions of this Revocable License or any security measures established by REA for the Museum. REA and the Museum’s Guest Health, Safety, and Conduct Policy is posted on the Museum’s website at http://efm.org/terms.


  16. This Agreement shall be governed by and construed under the laws of the State of New Jersey. In the event any term or provision of this Agreement is found to be unenforceable or void, in whole or in part, the term or provision shall be construed as valid and enforceable to the maximum extent permitted by law, and the remaining terms and provisions of this Agreement shall remain in full force and effect.
